Jose L Gonzalez has had an extensive legal career beginning with public service as an aide for a U.S. Congressman, a briefing clerk with the U.S. Office of Management & Budget (OMS)/Civil Rights Task Force and the U.S. Department of Justice in Washington, D.C., an Assistant Regional Attorney with the U.S. Dept. of Health Education & Welfare, the Dept. of Education, and a Senior Counsel with the FDIC and Resolution Trust Corporation Professional Liability Section in Dallas. In private practice, he has served primarily as a commercial litigator and trial attorney representing public governmental entities at the federal, state and municipal levels, and private sector clients, including Fortune 50 companies, in federal and state courts.

Represented and defended government and corporate clients in actions involving securities fraud, financial institution fraud and malfeasance, attorney malpractice, accountant’s malpractice and professional liability, breach of fiduciary duties by professionals, appraisers liability, fidelity bond claims, securities and commodities futures trading broker’s liability, creditor/debtor actions, evictions, real estate wrongful foreclosure, re-sale and refinancing agreements on foreclosure actions, security agreements, stock purchase agreements, breach of contract, breach of financing agreements, common law and statutory fraud, breach of Texas oral and written partnership agreements, quantum meruit claims, product liability claims (design & manufacturing), breach of express and implied warranties, deceptive trade practices, theft of trade secrets, sworn accounts, sales commissions, negligence and product liability, business disparagement, libel, slander, and prosecution of professional liability claims of bank receiverships for the RTC and FDIC.
Obtained significant settlements in an attorney malpractice claim, a securities churning claim against a major securities firm, a bank director and officer professional liability claim, D&O claims against a banker/investor/developer, and successfully defended and obtained summary judgment in several contract suits in federal and state court in claims for more than $3 million.
Labor and Employment
Represented and defended individuals, school districts and municipalities in actions involving claims for discrimination based on race, national origin, sex, disability and age under Titles VI, VII,IX, ADA, section 504, section 1983, section 1988 actions, USERRA, and complaints before the EEOC.
Represented the FDIC, RTC, Office of Thrift Supervision, US Department of Education, municipal governments, school districts, and federal bank receiverships in business litigation, inspector general investigations, fraud investigations, Freedom of Information Act litigation, Texas Public Information Act, employment discrimination, school desegregation suits, and educational placement of handicapped students
Prepared a Vaughn Index of more than 60,000 documents for the Office of Thrift Supervision (OCR) as part of the Whitewater investigation in a Freedom of Information Act suit between the agency and a Member of Congress.
Represented a school district in a fraud investigation that led to criminal convictions.
Represented major school districts in Texas in the dismissal of 40 year old desegregation orders.
